Personal data is any piece of information that allows us to identify you or make you identifiable, such as your name and contact details, your date of birth, photos, your email or telephone number, your login and password, or any other data that is or can be linked to you, such as your behavior on our website, your preferences, your location data, the IP address of your internet connection.

Under the EU General Data Protection Regulation (the "GDPR"), we may only process this data under very strict conditions, and as a visitor to our website, you have the right to know how we do this.

Please read this Privacy Statement carefully. We explain herein how we process your personal data and which cookies we use. By sharing your personal data on our website, by contacting us by email/telephone, or by submitting a question/complaint, you declare that you have taken note of this Privacy Statement.

Article 2 — What data do we process about you?

First Person Apparel processes the following personal data in the context of its activities:

When you contact us via the contact form on our website

When you contact us via the contact form or by email, we process your name, email address and the content of your message. We only use this data to answer your question. It is retained for a maximum of three months.

When you as a customer place an order in our webshop

We process your contact details, delivery address, billing details, payment details, information about your order and any account details. This data is processed in the context of the performance of our agreement with you, namely the correct handling and delivery of your order. Your data is retained for up to two years after your last order. Billing data is retained for ten years in the context of our legal accounting obligations.

When you create a user account

If you choose to create a user account on our website, we process your name, email address, address, order history and other data that you actively share with us. This data is processed to increase your user convenience and is retained for up to two years after your last interaction with our platform. If you have not placed an order with us for 2 years, we will automatically delete your account after first sending you a warning email.

When you subscribe to our newsletter

We process your first name and email address and collect analytical data about the use of our newsletters. For existing customers, this is done based on our legitimate interest. For non-customers, this is done only based on your explicit consent. You can unsubscribe at any time via the link in our emails. The data is retained for up to two years after your last interaction.

When you follow us on social media

First Person Apparel uses social media accounts on Instagram, Facebook, TikTok and LinkedIn. If you follow us there or interact with us, we process your username, profile information and the content of your messages or comments. We do this based on our legitimate interest to be in touch with our community and to promote our products.

Customer quotes and testimonials

If you give us permission, we process your data to place "our customers testify" quotes or testimonials on our website. For this we use your first name, name, quote and photo. This data may be placed on our website and on our social media channels such as Instagram, Facebook, TikTok and LinkedIn. You can request us at any time to remove this data from our website and channels.

Event visitors

When registering for events, we process your contact details, language preferences and telephone number. If you have your data scanned at our events or scan it yourself, we also process your contact details. This data is not shared with third parties. This data is retained for a period of 6 months. We do not use this data for advertising purposes unless you have explicitly consented to this.

When you book retreats and incentives

Through our webshop you can also book retreats and incentives in Ibiza. For this we process your name, contact details, language preference and payment details. This data is processed to handle your booking correctly. Administrative data is retained for up to two years after the event, billing data for up to ten years.

About hosting, payments and security

Our webshop is built on the Shopify platform. Shopify processes your data as a processor on our behalf. Payments are made through secure payment providers such as Apple Pay, Bancontact, Paypal, Google Pay, etc. All payment communication is via a secure SSL connection.

Processing of supplier data

If you are a supplier, we process your supplier data. This typically includes your company data, contact details of your involved employees, financial and billing data. This data is provided to us by you as a supplier and processed in the context of the performance of our agreement. We retain this data in accordance with our accounting obligations for a period of 10 years.

When you contact our customer care

We may also process your personal data in the context of our customer care. This is the case, for example, when you submit complaints or compliments to us via our website, by email, letter or telephone, or when we conduct customer satisfaction surveys.

In these cases, we process, depending on the specific situation, your name, title, email address, telephone number, whether or not you are a customer, the content of your complaint or compliment, your answers to our satisfaction survey, your address details. The data we process in this context may vary depending on the situation, but we always ensure that we do not process more data than is strictly necessary in each specific situation.

The personal data you share with us in this context was obtained directly from you and we use it exclusively in the context of handling your complaint or compliment or in the context of our customer satisfaction, based on our legitimate interest to work on customer satisfaction and quality of service.

After handling your complaint or compliment or after processing your responses to our customer satisfaction surveys, we retain your data for another 6 months.

While visiting our website

When you visit our website, we ask your permission to place cookies and other trackers (see further in the chapter "Cookies" for more information about our use of cookies).

If you give us permission to place analytical cookies or trackers, we collect analytical information about your browsing behavior on our website, such as your IP address, your (limited) location data, your unique online ID, information about the device you use to visit our website, the website from which you clicked through to our website and your browsing behavior on our website. We do this to improve your user experience on our website based on your preferences.

If you give us permission to place marketing cookies, we can register your actions as a website user to measure the effectiveness of an advertisement and to show you targeted advertisements.

Article 3 — With whom do we share your personal data?

All personal data will be transferred to the yet-to-be-established company First Person Apparel with a view to the future operation of the webshop by the latter, under the same conditions as those described in the current privacy policy.

We do not pass on your personal data to third parties for commercial reasons.

We can naturally share your data with service providers that we must use for the proper functioning of our website, our administration, IT and accounting. An up-to-date list of external processors with whom personal data is shared is available on request via info@firstpersonapparel.com. We carefully select these processors to guarantee your privacy and conclude a written agreement with each of them in which they guarantee that they respect all applicable data protection legislation. We choose European suppliers where possible, but if we have to use non-European third parties, we ensure that your data outside Europe is as secure as here in Europe. We conclude Standard Contractual Clauses with these partners where necessary and provide additional guarantees.

In case of internal reorganizations or transfer of our activities, we may pass on your data to other companies that can in that case guarantee the continuity of our services. We try to inform you in advance in such cases, but you understand that this is not technically or commercially feasible under all circumstances.

In rare cases, we may be required to disclose personal data based on a court order or to comply with other mandatory laws or regulations. We try to inform you in advance to the best of our ability, unless this is not possible for legal reasons.

Article 4 — What are your rights regarding your personal data?

As a data subject, if the conditions are met as stated in the GDPR, you have the right to:

  • You also have the right to request the correction or (in some cases) deletion of your data.
  • In a number of cases listed in the GDPR, you may also request to restrict the processing of your personal data.
  • You have the right to object to the processing of your personal data if you have serious and legitimate reasons for doing so that outweigh our need to process your data or to withdraw a previously given consent. You also always have the right to object to the use of personal data for direct marketing purposes, even without having to give a reason.
  • You have the right to request your personal data in digital and readable form and/or to have it transferred to other controllers to another service provider of your choice.

In any case, you have the right to file a complaint with the Belgian Data Protection Authority if we have not adequately responded to a request based on one of the above-mentioned rights within 30 days:

Article 5 — How do we secure your personal data?

We have taken appropriate security measures at technical and organizational level to guarantee the security of your personal data. For example, our server and software tools are secured with a username and password, access restrictions apply and multi-factor authentication is applied where possible as an extra security layer. Where possible, we apply encryption, both during storage and during data transfer. Furthermore, we provide training to our staff on data protection and have internal guidelines on data security.

Our IT infrastructure is actively monitored and protected with up-to-date antivirus software and firewalls. We continuously evaluate and improve our security measures to continue to meet the latest standards and legislation.

In the event of a security incident, we follow a strict internal protocol to quickly limit possible risks and, if necessary, to inform the competent authorities and data subjects in a timely manner.

Under no circumstances can First Person Apparel be held liable for any direct or indirect damage resulting from incorrect or unlawful use of the personal data by a third party.

Article 6 — Cookies

Our website uses cookies and similar technologies. This helps us provide you with a better user experience when you visit our website and also allows us to optimize our website. Without your prior consent, we only place strictly necessary cookies. For all other cookies, we first ask for your consent via our cookie banner. You can always manage your cookie preferences via the cookie banner in our footer. Your cookie consent has a validity period of 6 months, after which we will again poll your preferences.
